HAVE YOU EVER HEARD OF NEW YORK'S "MOVE OVER" LAW? This is a little known law passed in New York a few years ago to protect emergency highway personnel outside their vehicles. The Move Over law, which comes with 3 points and a fine of $275, requires a motorist to move over one lane, WHEN SAFELY POSSIBLE, upon approaching any emergency vehicle stopped on the shoulder or lane of a highway. Emergency vehicles include ambulances, tow trucks, highway maintenance and snow removal vehicles. For the statute to apply the vehicle must be stationary and have flashing red or white lights. It is worth noting that the statute contains a built-in defense, i.e. that the motorist was not able to SAFELY move over. THIS IS THE TYPE OF TICKET YOU SHOULD DEFINITELY FIGHT!
